Conditions of Use
§ 1 Area of Application
(1) The Conditions of use apply to all business connections between Gnostic Store and it's customers in the respective form at the time of the conclusion of the contract
(2) Our conditions of use are solely effective. Conflicting or deviant conditions of the customer are not accepted unless Gnostic Store has explicitly agreed to them in written form.§ 2 Effectiveness of the contract
(1) The display of Gnostic Store's assortment , on computers accessible over the internet, constitutes no commercial offer in the sense of § 145 ff BGB.
(2) By sending an order to Gnostic Store using the online shop, the customer is effectively making a a commercial offer in the sense of § 145 BGB. The customer receives an order reception confirmation via e-mail. In the case of possible mistakes in the statements related to Gnostic Store's assortment on the online store's website, Gnostic Store will advise the customer about it separately and will submit an adequate counteroffer to the customer.
(3) The contract with Gnostic Store becomes effective, when Gnostic Store accepts this offer. The acceptance is happening under the reservation of availability of the ordered goods. The explicit statement of acceptance through Gnostic Store towards the customer is not required, the customer renounces it in the sense of § 151 S. 1 BGB. In the case that Gnostic Store can't accept the customer's order, the customer will be notified in electronic form.
§ 3 Countermand
(1) The customer is entitled to revoke his declaration of intent related to the conclusion of the contract within 30 days upon receipt of the goods by sending back the goods to Gnostic Store. To keep the respite a duly dispatch is sufficient. The customer carries the burden of proof for the dispatch and the receipt of the goods to be sent back.
(2) The customer carries the costs of the reconsignment of the goods up to a value of 40 Euros, except the delivered goods did not correspond to the goods ordered. He is advised to use the most inexpensive method to return the goods.
(3) In the case of countermand Gnostic Store pays back the purchase price to the customer. If Gnostic Store had to make any payments concerning the reconsignment of the countermanded goods, these costs will be subtracted according to Abs. 2 HS 1. and upon payments to foreign countries the transfer charges will also be subtracted.
(4) If the goods show considerable signs of deterioration or if the goods get lost, the customer has to compensate Gnostic Store for the debasement of the goods in the case of countermand. Provided that the customer has already paid the purchase price, Gnostic Store is entitled to subtract the debasement value from the redemption amount In individual cases the debasement value can match the purchase value.
(5) Countermand is excluded if part of contracts a) related to audio- or videorecordings or software, if the delivered media have been desealed by the customer. b) relared to the delivery of goods that have been manufactured according to the customer's specifications. For the rest § 3 Abs. 2 FernabsG is effective.
(6) In the case of an exclusion of countermand and the reconsignment according to § 3 Abs. (2) FernAbsG the customer has to pay the costs for a new dispatch of the goods to him.
§ 4 Liability
(1) Für detriments due to the missing of attributes, that Gnostic Store has granted, Gnostic Store is fully liable. (2) A liability, particularly for detriments, that don't result directly from the goods, for missed out profits or other economic loss of the customer, is excluded.
§ 5 Final provisions
(1) These conditions submit solely to the material law of the federal republic of germany with the exception of the UN treaty of international purchase of movable goods.
(2) Sole place of jurisdiction for all claims in correlation with the business relation between Gnostic Store and the customer is Berlin, Germany.
Allgemeine Geschaeftsbedingungen des Gnostic Stores
§ 1 Geltungsbereich
(1) Diese allgemeinen Geschäftsbedingungen gelten für alle Geschäftsbeziehungen zwischen dem Gnostic Store und seinen Kunden in der jeweiligen, zum Zeitpunkt des Vertragsschlusses aktuellen Fassung.
(2) Unsere Allgemeinen Geschäftsbedingungen gelten ausschließlich. Entgegenstehende oder von unseren Geschäftsbedingungen abweichende Bedingungen des Kunden werden nicht anerkannt, es sei denn, Gnostic Store hat diesen im Einzelfall ausdrücklich schriftlich zugestimmt.
§ 2 Zustandekommen des Vertrages
(1) Die Darstellung des Sortiments von Gnostic Store, auf über das Internet abrufbaren Rechnern, stellt kein Angebot iSd §§ 145 ff BGB dar.
(2) Indem der Kunde eine Bestellung an Gnostic Store absendet, gibt er ein Angebot iSd § 145 BGB ab. Der Kunde erhält eine Bestätigung des Empfangs der Bestellung per e- mail. Auf mögliche Fehler in den Angaben zum Sortiment auf der Website wird Gnostic Store den Kunden ggf. gesondert hinweisen und ihm ein entsprechendes Gegenangebot unterbreiten.
(3) Der Vertrag mit Gnostic Store kommt zustande, wenn Gnostic Store dieses Angebot annimmt. Die Annahme erfolgt unter dem Vorbehalt der Verfügbarkeit der bestellten Ware oder Leistung. Die Erklärung der Annahme durch Gnostic Store gegenüber dem Kunden ist nicht erforderlich; der Kunde verzichtet insoweit auf diese iSv § 151 S. 1 BGB. Kann Gnostic Store das Angebot des Kunden nicht annehmen, wird dies dem Kunden in elektronischer Form mitgeteilt.
§ 3 Widerruf
(1) Der Kunde ist berechtigt, seine auf den Vertragsabschluss gerichtete Willenserklärung binnen 30 Tagen nach Erhalt der Ware zu widerrufen, indem er die Ware an Gnostic Store zurücksendet. Für die Wahrung der Frist genügt die rechtzeitige Absendung der Ware. Der Kunde trägt die Beweislast für die Absendung und den Zugang der zurückzusendenden Waren.
(2) Die Kosten der Rücksendung von Waren bis zu einem Wert von Euro 40,- trägt der Verbraucher, es sei denn, die gelieferte Ware oder Dienstleistung entspricht nicht der bestellten.
(3) Im Fall des Widerrufs zahlt Gnostic Storee einen ggf. bereits entrichteten Kaufpreis an den Kunden zurück. Von Gnostic Store ggf. bezahlte Rücksendungskosten gem. Abs. 2 HS 1 werden abgezogen. Bei Zahlungen ins Ausland werden zudem die Überweisungsgebühren abgezogen.
(4) Bei wesentlichen Verschlechterungen oder einem Verlust der Ware hat der Kunde im Fall seines Widerrufs Gnostic Store die entsprechende Wertminderung zu ersetzen. Sofern der Kunde den Kaufpreis bereits entrichtet hat, ist Gnostic Store berechtigt, die Wertminderung vom Rückzahlungsbetrag abzuziehen. Im Einzelfall kann die Wertminderung dem entrichteten Kaufpreis entsprechen.
(5) Das Widerrufsrecht ist ausgeschlossen bei Verträgen, a) die sich auf audio- oder videoaufnahmen oder software beziehen, wenn die gelieferten Medien vom Kunden entsiegelt worden sind. b) die sich auf Artikel betiehen, die nach den Wünschen des Kunden hergestellt wurden. Im übrigen gilt § 3 Abs. 2 FernabsG.
(6) Im Falle des Ausschlusses des Widerrufes und der Rückgabe gemäß § 3 Abs. (2) FernAbsG und gemäß § 6 Abs. (5) unserer AGB hat der Besteller bei einer Rücksendung der Ware an uns die Kosten der erneuten Versendung an ihn zu tragen.
§ 4 Haftung
(1) Für Schäden wegen Fehlens von Eigenschaften, die Gnostic Store zugesichert hat, haftet Gnostic Store unbeschränkt.
(2) Eine Haftung, insbesondere für Schäden, die nicht an der Ware selbst entstanden sind, für entgangenen Gewinn oder sonstige Vermögensschäden des Kunden, ist ausgeschlossen.
§ 5 Schlussbestimmungen
(1) Dieser Vertrag unterliegt ausschließlich dem materiellen Recht der Bundesrepublik Deutschland mit Ausnahme des UN-Abkommens über den internationalen Kauf beweglicher Sachen.
(2) Ausschließlicher Gerichtsstand für alle Ansprüche im Zusammenhang mit der Geschäftsbeziehung ist Berlin, Deutschland.
